VERIFIED PETITION TO ESTABLISH PATERNITY AND OTHER RELIEF

The Petitioner states as follows:

  1. Action: This is an action to determine paternity, parental responsibility, contact and access, and establish child support, pursuant to Florida Statutes, Chapter 742 and pertinent parts of Chapter 61.

  2. Residency: The Court has jurisdiction over the parties and the subject matter. Venue is proper in ____ County, Florida, where at least one of the parents resides.

  3. Paternity: The parties were never married to each other, but they had a sexual relationship that resulted in the birth of the minor child(ren) subject to these proceedings, to wit: __ __(initials) (male or female) born in 20_ _. The Petitioner respectfully requests that this Court enter an Order recognizing the ___ __ as the legal father of the minor child(ren) within a reasonable degree of medical certainty.

  4. Non-Military Status: The parties are over the age of (18) eighteen and neither is, nor has been, within a 30-day period, immediately prior to the date of this petition, a person in the military service of the United States, as defined by the Amended Sailors and Soldiers Civil Relief Act of 1940.

  5. UCCJEA: Pursuant to Florida Statutes §61.522, the UCCJEA will be filed under separate cover.

  6. Parenting Plan Settlement Agreement: The parties entered into a Parenting Plan Settlement Agreement, which resolves all issues relevant to these parties and these proceedings. This Agreement will be filed with the Court so that it can be approved, ratified and incorporated in a final judgment establishing paternity.

WHEREFORE, the Petitioner requests the following relief from this Honorable Court:

  1. Taking jurisdiction over the subject matter, the parties, and the minor child(ren);

  2. Recognize ___ __, as the legal father of the minor child(ren) within a reasonable degree of medical certainty;

  3. Determining that Florida is the minor child(ren)’s home state with the most significant contacts, that the United States is the country of habitual residence of the minor child and that venue is proper in _______ County;

  4. Approving and ratifying the parties’ Parenting Plan Agreement and incorporating it into the Final Judgment Establishing Paternity, but not merging with it;

  5. Granting such other further relief as it may deem equitable and just.
